1. About These Terms
This website is operated under the Ivamari brand. Throughout the website, the terms “we”, “us” and “our” refer to Ivamari.
These Terms and Conditions apply when you use our website or purchase products from us. By placing an order, you agree to these Terms together with any policies referred to within them.
Nothing in these Terms affects any statutory consumer rights that cannot legally be excluded or restricted.
2. Our Products
We make reasonable efforts to ensure that product descriptions, photographs, colours, measurements and other information displayed on our website are accurate.
Colours may appear slightly different depending on the screen or device used to view the website.
For garments made from Ankara wax print, motif placement and print positioning may vary slightly between individual pieces because garments are cut from patterned fabric.
Product measurements, fit information and fabric composition are provided on individual product pages. Customers should review this information before ordering, particularly where a garment is made from non stretch fabric.
Products and collections may be changed, withdrawn or discontinued without notice.
3. Prices and Payment
Prices are displayed according to the market and currency selected on the website.
The price payable for an order will be the price displayed at checkout when the order is placed, together with any delivery charges shown before payment.
We may change our prices at any time, but changes will not affect orders that have already been accepted.
Available payment methods are displayed at checkout.
4. Orders
After placing an order, you will receive an electronic confirmation using the contact details provided at checkout.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
• A product is unavailable
• Payment cannot be authorised
• Incorrect pricing or product information has been displayed
• We reasonably suspect fraud or unauthorised activity
• Delivery cannot be completed to the address provided
If payment has already been taken for an order that we cannot fulfil, the appropriate amount will be refunded.
Customers are responsible for ensuring that their delivery address, email address and other order information are correct when placing an order.
5. Processing and Delivery
In stock orders are normally processed and dispatched within 1 to 2 working days.
Estimated delivery times are provided on our Delivery & Returns page and at checkout where applicable.
Delivery estimates are not guaranteed delivery dates. Delays may occasionally occur for reasons outside our reasonable control, including courier disruption, customs processing, severe weather or other events affecting transportation.
Risk in the goods passes to you when the goods are delivered into your physical possession or to a person identified by you to receive them, subject to applicable consumer law.
6. International Orders, Customs and Duties
For most destinations, customs duties and import charges are covered by Ivamari so customers should not normally be required to make an additional customs payment when an order arrives.
Where this does not apply to a particular destination, any applicable charges will be communicated before the order is completed where required.
Delivery times for international orders may be affected by customs or local carrier processing.
7. Your Right to Cancel an Online Order
Customers may have statutory rights to cancel an online purchase depending on the law applicable to their order.
For UK consumers, eligible online purchases normally include a statutory cancellation period of 14 days after delivery.
A customer exercising a statutory cancellation right must notify us within the applicable cancellation period and return the goods within the time permitted by law.
Where a statutory cancellation applies, refunds will be made in accordance with applicable consumer law, including any refund of the standard outbound delivery charge where required.
Any additional delivery cost resulting from a customer choosing a delivery service more expensive than our standard delivery option may not be refundable.
This statutory right is separate from Ivamari’s additional 30 day return policy.
8. Ivamari 30 Day Return Policy
In addition to applicable statutory rights, Ivamari offers eligible customers a 30 day return period.
Returns under this policy must be initiated and sent back within 30 days of delivery.
Returned items must:
• Be unworn, unwashed and unused
• Be in their original condition
• Have all original product tags attached
• Be free from makeup, perfume, deodorant, stains and other signs of wear
• Be returned in their original product packaging
Items returned damaged, altered or in an unsuitable condition may not qualify for a refund under our voluntary return policy.
Customers are responsible for return postage unless an item is faulty, damaged or incorrect.
Full details are available in our Return Policy.
9. Clearance and Final Sale Items
Statutory consumer rights continue to apply to clearance and sale items.
Where a customer is entitled to exercise a statutory cancellation or refund right, that right is not affected simply because an item was purchased at a reduced price.
For returns made outside the applicable statutory cancellation period but within Ivamari’s additional 30 day return period, items clearly marked clearance or final sale may be returned for store credit only, provided they meet our standard return conditions.
10. Customised and Personalised Items
Goods made specifically to a customer’s individual specifications or clearly personalised may not qualify for statutory change of mind cancellation rights.
This does not affect a customer’s rights where an item is faulty, damaged, incorrectly supplied or otherwise does not conform to applicable consumer law.
Any return restrictions applying to a customised or personalised product will be made clear before purchase.
11. Faulty, Damaged or Incorrect Items
Customers should inspect their order after delivery.
If you receive an item that is faulty, damaged or incorrect, please contact us at hello@ivamari.com or through our Return Centre as soon as possible.
Our voluntary request that customers report visible problems promptly does not remove or restrict any statutory rights relating to faulty or misdescribed goods.
Where we are responsible for supplying a faulty, damaged or incorrect item, appropriate return postage will be covered by Ivamari where required.
12. Exchanges
We do not currently offer direct size or product exchanges.
If you require another size or a different item, you may return an eligible item in accordance with our Return Policy and place a new order.
13. Intellectual Property
The Ivamari name, branding, original website text, graphics, photography and other original content appearing on this website may be protected by copyright, trade mark, design or other intellectual property rights.
You may not reproduce, distribute, commercially exploit or use protected Ivamari content without permission except where permitted by law.
Nothing on this website transfers any intellectual property rights to website users or customers.
14. Website Availability
We take reasonable steps to keep our website available and accurate but cannot guarantee that access will always be uninterrupted or error free.
We may update, suspend or modify parts of the website where reasonably necessary.
15. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
Nothing in these Terms limits your statutory rights as a consumer, including rights relating to goods that are faulty, not as described or otherwise fail to meet legal requirements.
To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when an order was placed or that arise from circumstances outside our reasonable control.
16. Changes to These Terms
We may update these Terms from time to time.
The Terms applying to an order will normally be those in effect when that order was placed.
Any changes will be published on this website with the updated version taking effect from the date stated.
17. Governing Law
These Terms are governed by the laws of England and Wales.
If you are a consumer living outside England and Wales, you may also benefit from mandatory consumer protections that apply in your country or jurisdiction. Nothing in these Terms is intended to remove rights that cannot legally be excluded.
